    • Regulation 4 of the Information Technology (Reasonable Security Practices andProcedures and Sensitive Personal Information) Rules, 2011 (the “SPI Rules”);
    • Regulation 3(1) of the Information Technology (Intermediaries Guidelines) Rules, 2011.

    This Privacy Policy states the following: The type of information collected from the Users,including Personal Information (as defined in paragraph 2 below) and Sensitive Personal Data orInformation (as defined in paragraph 2 below) relating to an individual. The purpose, means andmodes of collection, usage, processing, retention and destruction of such information and howand to whom Q UP will disclose such information.

  2. COLLECTION OF PERSONAL INFORMATION

    Generally some of the Services require us to know who you are so that we can best meet yourneeds. When you access the Services, or through any interaction with us via emails, telephone calls or other correspondence, we may ask you to voluntarily provide us with certain informationthat personally identifies you or could be used to personally identify you. You hereby consent tothe collection of such information by Q UP. Without prejudice to the generality of the above,information collected by us from you may include (but is not limited to) the following:

    1. contact data (such as your email address and phone number);
    2. demographic data (such as your gender, your date of birth and your pin code);
    3. data regarding your usage of the services and history of the appointments made by orwith you through the use of Services;other information that you voluntarily choose toprovide to us (such as information shared by you with us through emails or letters.

    The information collected from you by Q UP may constitute ‘personal information’ or ‘sensitivepersonal data or information’ under the SPI Rules.

    “Personal Information” is defined under the SPI Rules to mean any information that relates to anatural person, which, either directly or indirectly, in combination with other information availableor likely to be available to a body corporate, is capable of identifying such person.

    The SPI Rules further define “Sensitive Personal Data or Information” of a person to mean personal information about that person relating to:

    1. passwords;
    2. financial information such as bank accounts, credit and debit card details or other payment instrument details;
    3. physical, physiological and mental health condition;
    4. sexual orientation;
    5. medical records and history;
    6. biometric information;
    7. information received by body corporate under lawful contract or otherwise;
    8. visitor details as provided at the time of registration or thereafter; and
    9. Q UP will be free to use, collect and disclose information that is freely available in the public domain without your consent.

    All Health records created either on the website or on the in clinic application are based uponyour consent. Such consent is deemed to be given when you visit the website or the clinic. It isthe sole responsibility of the clinic to make patients aware that the said establishment uses Q UPsoftware and services. Q UP will not be held liable for the failure of such communication fromclinic/practitioner. If you do not want to create your record please inform the clinic or doctorexpressly. In the case that you may wish to remove such a record you may contact us onhelp@qupapp.com Do note your data may still be held after removing personal identifiersmentioned above to facilitate continued services or analysis.

  3. PRIVACY STATEMENTS

    The terms in this Clause 4 are applicable only to Practitioners.

    1. ALL USERS NOTE:

      This section applies to all users.

      1. Accordingly, a condition of each User’s use of and access to the Services is theiracceptance of the Terms of Use, which also involves acceptance of the terms of this PrivacyPolicy. Any User who does not agree with any provisions of the same has the option todiscontinue the Services provided by Q UP immediately including access to website and otherproducts.
      2. An indicative list of information thatQ UP may require you to provide to enableyour use of the Services is provided in the Schedule annexed to this Privacy Policy.
      3. All the information provided to Q UPby a User, including Personal Information orany Sensitive Personal Data or Information, is voluntary. You understand that Q UP may usecertain information of yours, which has been designated as Personal Information or ‘SensitivePersonal Data or Information’ under the SPI Rules
        • for the purpose of providing you theServices,
        • for commercial purposes and in an aggregated or non-personally identifiable formfor research, statistical analysis and business intelligence purposes,
        • for sale or transfer ofsuch research, statistical or intelligence data in an aggregated or non-personally identifiable formto third parties and affiliates
        • for communication purpose so as to provide You a better way ofbooking appointments and for obtaining feedback in relation to the Practitioners and theirpractice,
        • debugging customer support related issues.

        Q UP also reserves the right to useinformation provided by or about the End-User for the following purposes:

        1. Publishing such information on the Website.
        2. Contacting End-Users for offering new products or services.
        3. Contacting End-Users for taking product and Service feedback.
        4. Analyzing software usage patterns for improving product design and utility.
        5. Analyzing anonymized practice information for commercial use.
      4. Collection, use and disclosure of informationwhich has been designated asPersonal Information or Sensitive Personal Data or Information’ under the SPI Rules requires yourexpress consent. By affirming your assent to this Privacy Policy, you provide your consent to suchuse, collection and disclosure as required under applicable law.
      5. Q UP does not control or endorse thecontent, messages or information found inany Services and, therefore, Q UP specifically disclaims any liability with regard to the Servicesand any actions resulting from your participation in any Services, and you agree that you waiveany claims against Q UP relating to same, and to the extent such waiver may be ineffective, youagree to release any claims against Q UP relating to the same.
      6. You are responsible for maintainingthe accuracy of the information you submit tous, such as your contact information provided as part of account registration. If your personalinformation changes, you may correct, delete inaccuracies, or amend information by making thechange on our member information page or by contacting us through help@qupapp.com. We willmake good faith efforts to make requested changes in our then active databases as soon as reasonably possible. There may be circumstances where Q UP will not correct, delete or updateyour Personal Data, including (a) where the Personal Data is opinion data that is kept solely forevaluative purpose; and (b) the Personal Data is in documents related to a prosecution if allproceedings relating to the prosecution have not been completed
      7. If you wish to cancel your account orrequest that we no longer use yourinformation to provide you Services, contact us through help@qupapp.com . We will retain yourinformation for as long as your account with the Services is active and as needed to provide youthe Services. We shall not retain such information for longer than is required for the purposes forwhich the information may lawfully be used or is otherwise required under any other law for thetime being in force. After a period of time, your data may be anonymized and aggregated, andthen may be held by us as long as necessary for us to provide our Services effectively, but ouruse of the anonymized data will be solely for analytic purposes. Please note that your withdrawalof consent, or cancellation of account may result in Q UP being unable to provide you with itsServices or to terminate any existing relationship Q UP may have with you.
      8. If you wish to opt-out of receivingnon-essential communications such aspromotional and marketing-related information regarding the Services, please send us an emailat help@qupapp.com.
      9. Due to the communications standardson the Internet, when a User or the End-Useror anyone who visits the Website, Q UP automatically receives the URL of the site from whichanyone visits. Q UP also receives the Internet Protocol (IP) address of each User’s computer (orthe proxy server a User used to access the World Wide Web), User’s computer operating systemand type of web browser the User is using, email patterns, as well as the name of User’s ISP. Thisinformation is used to analyze overall trends to help Q UP improve its Service. The linkagebetween User’s IP address and User’s personally identifiable information is not shared with ordisclosed to third parties. Notwithstanding the above, Q UP may share and/or disclose some ofthe aggregate findings (not the specific data) in anonymized form (i.e., non-personallyidentifiable) with advertisers, sponsors, investors, strategic partners, and others in order to helpgrow its business.

The Website uses temporary cookiesto store certain (that is not sensitivepersonal data or information) that is used by Q UP and its service providers for the technicaladministration of the Website, research and development, and for User administration. In thecourse of serving advertisements or optimizing services to its Users, Q UP may allow authorizedthird parties to place or recognize a unique cookie on the User’s browser. The cookies however,do not store any Personal Information of the User. You may adjust your internet browser todisable cookies. If cookies are disabled you may still use the Website, but the Website may belimited in the use of some of the features.
      11. A User may have limited access to theWebsite without creating an account on theWebsite. Users can make appointments with the doctors by providing their name and phonenumber through Mobile Application.
      12. This Privacy Policy applies to Servicesthat are owned and operated by Q UP. Q UPdoes not exercise control over the sites displayed as search results or links from within itsServices. These other sites may place their own cookies or other files on the Users’ computer,collect data or solicit personal information from the Users, for which Q UP is not responsible or liable. Accordingly, Q UP does not make any representations concerning the privacy practices orpolicies of such third parties or terms of use of such websites, nor does Q UP guarantee theaccuracy, integrity, or quality of the information, data, text, software, sound, photographs,graphics, videos, messages or other materials available on such websites. The inclusion orexclusion does not imply any endorsement by Q UP of the website, the website's provider, or theinformation on the website. If you decide to visit a third party website linked to the Website, youdo this entirely at your own risk. Q UP encourages the User to read the privacy policies of thatwebsite.
      13. Q UP does not collect information aboutthe visitors of the Website from othersources, such as public records or bodies, or private organisations, save and except for thepurposes of registration of the Users (the collection, use, storage and disclosure of which eachEnd User must agree to under the Terms of Use in order for Q UP to effectively render theServices).
      14. Q UP maintains a strict "No-Spam" policy,which means that Q UP does not intendto sell, rent or otherwise give your e-mail address to a third party without your consent.
      15. Q UP has implemented best market practicesand security policies, rules andtechnical measures to protect the personal data that it has under its control from unauthorisedaccess, improper use or disclosure, unauthorised modification and unlawful destruction oraccidental loss. However, for any data loss or theft due to unauthorized access to the User’selectronic devices through which the User avails the Services, Q UP shall not be held liable forany loss whatsoever incurred by the User.

Q UP implements reasonable securitypractices and procedures and has acomprehensive documented information security programme and information security policiesthat contain managerial, technical, operational and physical security control measures that arecommensurate with respect to the information being collected and the nature of Q UP’sbusiness.
      17. Q UP takes your right to privacy veryseriously and other than as specifically statedin this Privacy Policy, will only disclose your Personal Information in the event it is required to doso by law, rule, regulation, law enforcement agency, governmental official, legal authority orsimilar requirements or when Q UP, in its sole discretion, deems it necessary in order to protectits rights or the rights of others, to prevent harm to persons or property, to fight fraud and creditrisk, or to enforce or apply the Terms of Use.

    2. PRACTITIONERS NOTE

      This section applies to all Practitioners.

      1. As part of the registration as wellas the application creation and submissionprocess that is available to Practitioners on Q UP, certain information, including PersonalInformation or Sensitive Personal Data or Information is collected from the Practitioners.
      2. All the statements in this Privacy Policyapply to all Practitioners, and allPractitioners are therefore required to read and understand the privacy statements set out hereinprior to submitting any Personal Information or Sensitive Personal Data or Information to Q UP,failing which they are required to leave the Services, including the Website immediately.
      3. Practitioners’ personally identifiable information, which they choose to provide to QUP, is used to help the Practitioners describe and identify themselves. This information isexclusively owned by Q UP. You will be the owner of your information and you consent to Q UPcollecting, using, processing and/or disclosing this information for the purposes hereinafterstated . Q UP may use such information for commercial purposes and in an aggregated ornon-personally identifiable form for research, statistical analysis and business intelligencepurposes. Q UP also reserves the right to use information provided by or about the Practitionerfor the following purposes:
        1. Publishing such information on the Website.
        2. Contacting Practitioners for offering new products or services.
        3. Contacting Practitioners for taking product feedback.
        4. Analyzing software usage patterns for improving product design and utility.
        5. Analyzing anonymized practice information including financial, and inventory informationfor commercial use.
      4. Q UP automatically enables the listingof Practitioners’ information on its Websitefor every ‘Doctor’ or ‘Clinic’ added to a Practice using its software. The Practitioner informationlisted on Website is displayed when End-Users search for doctors on Website, and thePractitioner information listed on Website is used by End-Users to request for doctorappointments. Any personally identifiable information of the Practitioners listed on the Website isnot generated by Q UP and is provided to Q UP by Practitioners who wish to enlist themselves onthe Website, or is collected by Q UP from the public domain. Q UP displays such information onits Website on an as-is basis making no representation or warranty on the accuracy orcompleteness of the information. As such, we strongly encourage Practitioners to check theaccuracy and completeness of their information from time to time, and inform us immediatelyfor any discrepancies, changes or updates to such information. Q UP will, however, takereasonable steps to ensure the accuracy and completeness of this information.
      5. Q UP may also display information forPractitioners who have not signed up orregistered for the Services, provided that the Practitioners have consented to Q UP collecting,processing and/or disclosing their information on the Website. Such Practitioners are verified byQ UP or its associates, and Q UP makes every effort to capture accurate information for suchPractitioners. However, Q UP does not undertake any liability for any incorrect or incompleteinformation appearing on the Website for such Practitioners.

    3. END-USERS NOTE

      This section applies to all End-Users.

      1. As part of the registration/applicationcreation and submission process that isavailable to End-Users on this Website, certain information, including Personal Information orSensitive Personal Data or Information is collected from the End-Users.
      2. All the statements in this Privacy Policyapply to all End-Users, and all End-Users aretherefore required to read and understand the privacy statements set out herein prior tosubmitting any Personal Information or Sensitive Personal Data or Information to Q UP, failingwhich they are required to leave the Q UP immediately.
      3. If you have inadvertently submitted any such information to Q UP prior to readingthe privacy statements set out herein, and you do not agree with the manner in which suchinformation is collected, processed, stored, used or disclosed, then you may access, modify anddelete such information by using options provided on the Website. In addition, you can, bysending an email to help@qupapp.com, inquire whether Q UP is in possession of your personaldata, and you may also require Q UP to delete and destroy all such information.
      4. End-Users’ personally identifiable information,which they choose to provide on theWebsite is used to help the End-Users describe/identify themselves. Other information that doesnot personally identify the End-Users as an individual, is collected by Q UP from End-Users (suchas, patterns of utilization described above) and is exclusively owned by Q UP. Q UP may also usesuch information in an aggregated or non-personally identifiable form for research, statisticalanalysis and business intelligence purposes. In particular, Q UP reserves with it the right to useanonymized End-User demographics information and anonymized End-User health informationfor the following purposes:
        1. Analyzing software usage patterns for improving product design and utility.
        2. Analyzing such information for research and development of new technologies.
        3. Using analysis of such information in other commercial product offerings of Q UP.
        4. Sharing analysis of such information with third parties for commercial use.
      5. Q UP will communicate with the End-Usersthrough email, phone and noticesposted on the Website or through other means available through the service, including text andother forms of messaging. The End-Users can change their e-mail and contact preferences atany time by logging into their "Account" at www.qupapp.comand changing the account settings.
      6. Q UP may keep records of electroniccommunications and telephone calls receivedand made for making appointments or other purposes for the purpose of administration ofServices, customer support, research and development and for better listing of Practitioners.
      7. All Q UP employees and data processors,who have access to, and are associatedwith the processing of sensitive personal data or information, are obliged to respect theconfidentiality of every End-Users’ Personal Information or Sensitive Personal Data andInformation. Q UP has put in place procedures and technologies as per good industry practicesand in accordance with the applicable laws, to maintain security of all personal data from thepoint of collection to the point of destruction. Any third-party data processor to which Q UPtransfers Personal Data shall have to agree to comply with those procedures and policies, or putin place adequate measures on their own.
      8. Q UP may also disclose or transfer End-Users’personal and other informationprovided by a User, to a third party as part of reorganization or a sale of the assets of a Q UPcorporation division or company. Any third party to which Q UP transfers or sells its assets to willhave the right to continue to use the personal and other information that End-Users provide to us,in accordance with the Terms of Use

    4. CASUAL VISITORS NOTE

      1. No sensitive personal data or informationis automatically collected by Q UP fromany casual visitors of this website, who are merely perusing the Website.
      2. Nevertheless, certain provisions of this Privacy Policy are applicable to even suchcasual visitors, and such casual visitors are also required to read and understand the privacystatements set out herein, failing which they are required to leave this Website immediately.

Further, Q UP shall not be responsible for anybreach of security or for any actions of any third parties or events that are beyond the reasonablecontrol of Q UP including but not limited to, acts of government, computer hacking, unauthorisedaccess to computer data and storage device, computer crashes, breach of security andencryption, poor quality of Internet service or telephone service of the User etc.

  5. CHANGE TO PRIVACY POLICY

    In the event there are significant changes in the way Q UP treats User’s personally identifiableinformation, or in the Privacy Policy itself, Q UP will display a notice on the Website or send Usersan email, as provided for above, so that you may review the changed terms prior to continuing touse the Services. As always, if you object to any of the changes to our terms, and you no longerwish to use the Services, you may contact help@qupapp.com to deactivate your account. Unlessstated otherwise, Q UP’s current Privacy Policy applies to all information that Q UP has about youand your account. If a User uses the Services or accesses the Website after a notice of changeshas been sent to such User or published on the Website, such User hereby provides his/her/itsconsent to the changed terms.

    Q UP strongly encourages parents and guardians to supervise the online activities of their minorchildren and consider using parental control tools available from online services and softwaremanufacturers to help provide a child-friendly online environment. These tools also can preventminors from disclosing their name, address, and other personally identifiable information onlinewithout parental permission. Although the Q UP Website and Services are not intended for use byminors, Q UP respects the privacy of minors who may inadvertently use the internet or the mobileapplication.

    Indicative List of Information by Nature of Service

    1. End-Users registering for an account on ‘Q UP’ mobile application: You can create anaccount by giving us information regarding your [name, mobile number], and such otherinformation as requested on the End-User registration page. This is to enable us toprovide you with the facility to use the account to book your appointments and storeother health related information.
    2. Practitioner availing of the free listing service on the Website or ‘Q UP’ mobile applicationby registering for an account: As a Practitioner, you may be required to provide us withinformation regarding your [name, mobile number, email address], and such otherinformation as requested. Q UP may send email and/or SMS confirmations or othercommunications to End-Users in connection with their bookings, appointments or otherinteractions with you, if such interactions have been facilitated by Q UP.

  10. TRAFFIC DATA COLLECTED

    We automatically track and collect the following categories of information when you visit ourSite:

    1. IP addresses;
    2. domain servers;
    3. types of devices accessing the Site;
    4. types of web browsers used to access the Site;
    5. referring source which may have sent you to the Site; and
    6. other information associated with the interaction of your browser and the Site(collectively "Traffic Data”).

  11. NTERACTIVE AND INSTALLED TOOLS

    We also collect other information, some of which may be Personal Information that youvoluntarily provide to us when you choose to use some of the our interactive tools and services("Interactive Tools"), such as searching for Providers and searching for available appointmentswith them. We also collect information you provide voluntarily in free-form text boxes on the Siteand through responses to surveys, questionnaires and the like. Some of the free Interactive Toolson our Site ask you for health-related Personal Information. You may elect to use certain Servicesavailable through the Site that require you to download and install software on your computer("Installed Tools"). The Installed Tools may collect and transmit information from your computersystem solely relating to use of the Installed Tools and for the purpose of providing you therelevant Services, for example, by informing Q UP when a user is logged on and available toreceive update or alert notices.

  12. WEBSITE ANALYTICS

    We may use third party website analytics services in connection with the Site. These websiteanalytics services do not collect Personal Information that you do not voluntarily enter into theSite. These services do not track your browsing habits across websites which do not use theirservices. We are using the information collected from these services to find usability problems tomake the Site easier to use. The recordings will never identify you or your account.

    We store all Traffic Data and review postings indefinitely, even after "deletion," and may archivesuch information elsewhere. We store all Personal Information until you request that we modifyor delete it, in which case we may still wind up retaining some of that information.

    We may use your Personal Information to recommend certain resources or medical providers.We may use your Contact Data to send you information about Q UP or our products or Services,to contact you when necessary, including to remind you of upcoming or follow-up appointments,and in conjunction with your use of certain Interactive Tools.
